DETERMINATION OF DIRECTIONS FOR COMBATING ADMINISTRATIVE OFFENCES IN THE SPHERE OF ENVIRONMENTAL PROTECTION

The article examines the main directions of counteraction to violations in the field of environmental protection in Ukraine through the prism of their legal nature, content and place in the system of public and legal response. It is substantiated that such counteraction is complex in nature and cannot be reduced to one type of state influence, since it encompasses interrelated preventive, control, jurisdictional and restorative directions.

It has been established that the preventive direction is associated with the formation of a regime of environmentally safe behavior, legal information, as well as the elimination of the causes and conditions of violations, while the control direction is aimed at identifying environmentally hazardous activities, recording violations, collecting evidentiary information, and promptly terminating illegal actions.

It is proven that the jurisdictional and compensatory and restorative directions are of a final nature, since through them the qualification of the violation, the application of the appropriate type of legal liability, compensation for damage and the restoration of the violated environmental law and order are carried out. Special attention is paid to the directions of improving the administrative and legal support for combating violations in the field of environmental protection in the conditions of modern ecological, institutional and military challenges.

It is argued that the systematic updating of the regulatory and procedural framework for response, bringing environmental protection proceedings to an internally coordinated model of administrative procedure, unifying the rules for proving environmental damage, establishing uniform requirements for motivating decisions of regulatory bodies, and procedural synchronization of actions of environmental control bodies, police, local governments, and judicial institutions are of paramount importance.

At the same time, the need for institutional strengthening of state environmental control, digitalization of monitoring, creation of integrated environmental information resources, standardization of procedures for documenting war damage to the environment, and harmonization of the national response mechanism with European approaches is substantiated.

It is concluded that only the unity of preventive, control, jurisdictional and restorative directions forms a holistic mechanism for environmental protection and ensures the proper level of environmental security of the state.
