METHODOLOGICAL TURN: FROM GENERAL JURISPRUDENCE TO THE PHILOSOPHY OF PRIVATE LAW
The article is devoted to the philosophical and legal analysis of the problems of the general methodology of modern legal science from the standpoint of jusnaturalism, which is fundamentally opposed to legal positivism. The results of philosophical reflections on methodological problems convince that a qualitatively new conceptualization of law determines the need to form fundamentally new worldview approaches to the organization of specialized legal research.
The authors concluded that the formation of a new world legal order in the modern era of the information society has a transnational character and therefore it is formed on the principles of private, not public law. Therefore, the understanding of the ideological principles of the transformation of law must be carried out within the framework of such a system as the philosophy of private law, which is actively institutionalized at the intersection of jurisprudence and philosophical knowledge and claims to clarify the nature of modern globalized relations, their subjects and mechanisms of regulation.
Keywords: theoretical jurisprudence, philosophy of law, legal positivism, philosophy of natural law, paradigm of law, philosophy of private law, globalization, law of the information society, methodology of law.
