REGULATION MAKING OF SELF-REGULATORY ORGANIZATIONS: ESSENCE, CONTENT AND FORMS

The article is devoted to the theory of law-making. The authors emphasize the importance of distinguishing between formal and informal rule-making. Formal rule-making is carried out by registered competent state bodies according to established procedures, while informal rule-making, known as notification and comment rule-making, involves the creation of norms through less formal processes.

Examples of the activities of self-regulatory organizations (SROs) indicate that in Western doctrine (mainly in the USA and Canada) they have the authority to create and enforce industry regulations, acting as quasi-regulatory bodies under the supervision of state authorities.

In Western doctrine, there are three terms for self-regulatory organizations: (1) Self-regulatory organizations (SROs), which are authorized to create rules and standards in a specific industry/sector or profession without direct state supervision and to monitor their proper application (including the application of sanctions to entities that violate them); (2) Self-regulating organizations – organizations that establish their own rules and standards without the mandatory formal recognition as an SRO or authority from a regulatory body; (3) Self-regulation organizations – organizations focused on internal self-regulatory practices without the need for formal status or state recognition.

All three terms are translated into Ukrainian as “self-regulatory organizations,” but have different meanings.

Historically, arbitration has developed as a self-regulatory system, where rules and standards are created and promoted by non-governmental organizations, associations, or groups without SRO status. The authors analyze the most common forms of rulemaking used by the Ukrainian Arbitration Association and other public organizations in the field of arbitration.

The authors view self-regulation as the autonomous development and implementation of rules by relevant actors, often referred to as “soft law.” They also analyze the reasons for the creation of self-regulatory organizations and the need for non-state lawmaking with the participation of the public and experts for more flexible private rulemaking.

Keywords: lawmaking, lawmaking, norm-making, self-regulation, self-regulatory organizations, soft law.
