SUBJECT OF COLLABORATIVE ACTIVITY: CERTAIN DISCUSSION ASPECTS
The armed aggression of the Russian Federation against Ukraine, which initially took a hidden, hybrid form, has been going on for almost ten years, and throughout this time, manifestations of collaborationism have been observed and continue to be observed.
With the beginning of the full-scale invasion, criminal liability was introduced for a new offense – collaboration activities: on March 3, 2022, the Criminal Code of Ukraine (hereinafter referred to as the CC) was supplemented by Article 111-1 [1] based on the Law “On Amendments to Certain Legislative Acts of Ukraine Regarding the Establishment of Criminal Liability for Collaboration Activities”. The latter contains 8 parts, thanks to which various types of criminal offenses with specific features were actually distinguished – public denial of the Russian Federation’s armed aggression against Ukraine, public calls by a citizen of Ukraine to support the decisions and/or actions of the aggressor state, voluntary occupation by a citizen of Ukraine of a position not related to the performance of organizational, managerial or administrative-economic functions in illegal government bodies, propaganda in educational institutions, etc.
