THEORETICAL AND LEGAL CONTENT OF THE CONCEPT OF “ADAPTION OF LEGISLATION”

The article defines the theoretical and legal content of the concept of “adaptation of legislation” based on comparative legal analysis with related legal phenomena, in particular: universalization and harmonization of law, unification and implementation of law, incorporation of law and transformation of law, reference and reception of law.

It is emphasized that the concept of “adaptation of legislation” is widely used in legal circles, but there is no unambiguous interpretation at the semantic and general theoretical levels in legal science and practice.

In legal activities, adaptation of legislation is used as one of the methods of legal integration and at the same time a preparatory stage for the harmonization and/or unification of national legislation with the legal acts of the European Union.

Analyzing the provisions of the national legislation of Ukraine on adaptation issues, a tendency to interpret adaptation in terms of exclusively legislative methods and means was noted. Based on this, the conclusion was made that the process of bringing Ukrainian legislation into line with the acquis communautaire is limited only to legislative adaptation.

Accordingly, the adaptation of legislation to the acquis of the European Union is a legal activity of approximating the legal system of society, including lawmaking, legal techniques and practices, and law enforcement, to the legal system of the European Union.

Keywords : adaptation of legislation, universalization and harmonization of law, unification and implementation of law, incorporation of law and transformation of law, reference and reception of law.
