THREE WHALES OF CIVILIZATIONAL THINKING BY GENNADY KONSTIANTYNOVICH MATVEEV
The article is the first in Ukrainian civil law science to specifically investigate the phenomenon of civilistic thinking of Gennady Konstantinovich Matveyev. The main source base for the study was his dissertation for the degree of Doctor of Law “Fault as a Ground for Civil Liability”, the monographs “Fault in Soviet Civil Law”, “Grounds for Civil Liability”, the works “History of Family and Matrimonial Legislation of the Ukrainian SSR”, “Soviet Family Law” and over thirty scientific articles by the author.
The prerequisites for the formation of G. K. Matveyev’s civilistic thinking are clarified, mainly the influence on it of the fundamental principle of the Soviet state policy “we do not recognize anything private”, the “Khrushchev thaw” and the actualization of the Roman archetype of private law in Europe in connection with the formation of the European Community of Member States. According to the canons of scientific knowledge, the quintessence of the scientist’s scientific thinking style is most clearly manifested in the way he formulates and solves research problems, in the system of his argumentation of innovative provisions, assessments, generalizations and conclusions. It is the most important methodological key to an authentic understanding of the scientist’s scientific achievements. The method of civilistic thinking of G. K. Matveyev is no exception in this series. It was based on the following three fundamental factors: 1) the Roman archetype of private law as a paradigmatic matrix of his civilistic thinking; 2) personocentrism as an axiological standard of G. K. Matveyev’s civic thinking; 3) phenomenology as a methodological principle of G. K. Matveyev’s civic thinking. Applied systematically and in complementarity, it was these cognitive tools that mainly ensured the scientific novelty and recognition of G. K. Matveyev’s work in domestic civics as a whole.
Keywords: G. K. Matveev; civilistic thinking; Roman archetype of private law; paradigmatic matrix of civilistic thinking; personocentrism of civilistic thinking; phenomenological nature of civilistic thinking.
