MUNICIPAL SELF-GOVERNMENT ON UKRAINIAN LANDS UNDER MAGDEBURG LAW: THEORETICAL ASPECT AND PRACTICAL DIMENSIONS
The article is devoted to the analysis of city self-government in Ukrainian lands under Magdeburg law, which spread to Ukraine in the 14th — 15th centuries. through Poland and Hungary. It is emphasized that the legal consequences of granting the city Magdeburg law were: removing the city from the jurisdiction of the local administration (feudal lords, voivodes, governors, etc.) and introducing its own body of city self-government – the magistrate, which consisted of two boards – the council (administrative body) and the bench (judicial body).
The author concludes that in modern Ukraine, public authority reforms have not led to the formation of viable territorial communities and real local self-government.
Keywords: Magdeburg law, local self-government, territorial community, public authority reforms, division of powers between the government and local self-government, modern model of local self-government.
