ОСОБЛИВОСТІ ЕВОЛЮЦІЇ ПРАВОВОГО РЕГУЛЮВАННЯ КЛІМАТИЧНОЇ БЕЗПЕКИ В ЄС

У роботі розглянуто історію виникнення та розвитку кліматичного законодавства в Європейському Союзі. Показано, що до 90-х років минулого століття проблемою глобального потепління клімату в основному опікувались лише науковці, на загрозливі передбачення яких майже не реагували уряди переважної кількості країн, хоча вже давно було відомо про вплив викидів парникових газів на глобальне потепління.

Так, в статті звернено увагу на перші задокументовані згадки про можливі загрози зміни клімату внаслідок парникового ефекту, датовані ще першою половиною-серединою 19-го століття, та пов’язані з іменами таких видатних вчених, як французький математик та фізик Жозеф Фур’є, американська вчена-фізик Юніс Фут, шведський фізико-хімік Сванте Август Арреніус, ірландський фізик Джон Тіндаль.

Відзначено основні міжнародні конвенції та інші угоди, пов’язані з регулюванням у кліматичній сфері, простежено послідовність їх прийняття, оцінено ступень їх важливості та вплив на формування європейського кліматичного законодавства, спрямованого на боротьбу з глобальним потеплінням шляхом зменшення емісії парникових газів. Серед найбільш важливих подій, які сприяли початку розвитку кліматичної політики ЄС, виділено конференцію ООН у Стокгольмі 1972 року, коли вперше заговорили про цю проблему і в результаті ухвалили Стокгольмську декларацію з 26 принципів і 109 пунктів плану дій з навколишнього середовища, та прийняття Рамкової Конвенції ООН про зміну клімату (РКЗК ООН) 1992 року, до якої приєдналося 198 країн, включаючи Україну, яка ратифікувала документ у 1996 році.

Значною міжнародною подією, яку активно просував ЄС, стало введення системи торгівлі квотами на викиди (Emissions Trading System), що динамічно розвивається, особливо після прийняття Кіотського протоколу в 1997 році, який став першим випадком, коли майже всі країни взяли на себе юридичні зобов’язання щодо скорочення антропогенних викидів парникових газів.

Наступним важливим документом, який сприяв розвитку європейського кліматичного законодавства, стала Паризька угода 2015 року. Ключовою відмінністю цієї угоди від Кіотського протоколу стало те, що угодою не передбачено жорсткої вимоги у вигляді зобов’язань жодній зі сторін щодо конкретних обмежень у викидах парникових газів, а запропоновано кожній окремій країні самостійно встановлювати такі зобов’язання, за якими вони надалі звітують з урахуванням національно визначених внесків, або NDC (nationally determined contribution).

Розглянуто відповідність сучасного українського законодавства європейському правовому полю у кліматичній сфері. Зроблено висновок щодо недосконалості сьогоднішньої кліматичної політики України. Зокрема, наразі взагалі немає чіткого нормативно-правового регулювання антропогенних викидів метану, особливо в аграрному секторі; відсутнє законодавчо закріплене поняття «кліматична безпека» (climate security), яке зараз не відокремлюється у вітчизняному законодавстві від терміну екологічна безпека. Тоді як у Європейському Союзі вже давно «кліматична безпека» (climate security) є абсолютно автономною гілкою розвитку кліматичного законодавства. В Законі України «Про основні засади державної кліматичної політики», лише в одному місці у статті 3 закону згадується термін «кліматична безпека», але не наведено його дефініцію. Також наголошено на необхідності вдосконалення вітчизняного законодавства у кліматичній сфері шляхом його адаптації до європейського законодавства, в першу чергу потребує розробки та прийняття комплексного Закону «Про клімат».
